Apex Rally Co. Terms and Conditions

1. General Information Apex Rally Co. events (the "Event") are pre-organised navigational driving experiences and are not races, time trials, or rallies. There is no competitive element. Participants will receive a route plan or checkpoint list which they may navigate to using their own GPS device or sat nav. You may follow the suggested route or create your own.

Participants must not engage in any form of competition with other road users or participants, nor place bets relating to the event. Any breach will result in immediate removal from the event without refund. All participants must drive responsibly and adhere to road laws and speed limits.

All bookings made under a lead name are considered agreement to these Terms.

2. Age Restrictions Participants must be 18 years or older.

3. Entry Fee A non-refundable deposit is required to secure your place. Final balances must be paid no later than 30 days prior to the event. Late payments will incur a £250 GBP per person fee.

Tour fees include Eurotunnel or ferry crossings unless otherwise specified. Tour fees exclude personal expenses (fuel, tolls, meals unless stated, fines, or damages). Any unpaid charges related to accommodation will be invoiced and must be paid within 7 days or will incur a £50 per day late fee.

No refunds will be issued under any circumstance, including but not limited to cancellations, inability to attend, withdrawal during the event, or removal due to breach of terms.

4. Hotel Accommodation Hotel stays are included at each tour destination, typically 4 or 5-star hotels with breakfast for two. Room type preferences (Twin/Double) will be accommodated where possible.

Accommodation may be self catering/ exclusive villa/ glamping lodges etc and will be specified beforehand.

Accommodation may change prior to the event 

Credit card details are required upon check-in for incidental charges. Damage or unpaid charges will be invoiced post-event.

5. Cancellation / Changes Unpaid balances will result in cancellation without refund. Apex Rally Co. reserves the right to change the itinerary without notice.

6. Code of Conduct Participants must behave respectfully and lawfully. Driving under the influence of alcohol or drugs is strictly forbidden. If unfit to drive, you must not operate a vehicle. Failure to comply will result in removal from the event.

7. Legal Compliance Participants must comply with all laws in the countries visited, including but not limited to speed limits and roadworthiness requirements.

Only registered vehicles may be used unless permission is granted. Failure to comply will result in removal from the event.

8. Channel Crossings Eurotunnel/Ferry bookings are made using provided details. Missed departures may result in additional charges and the participant must arrange and pay for alternate travel.

9. Responsibility Apex Rally Co. accepts no responsibility for denied border crossings or associated costs.

10. Indemnity You agree to indemnify Apex Rally Co., its staff, directors, and affiliates against any claims or actions resulting from your participation.

11. Licence and Insurance All drivers must hold a valid driving licence, passport, and relevant insurance. Proof of insurance must be shown during registration. Hired vehicles must be disclosed.

Participants are responsible for legal compliance and any incidents or damage during the event. Apex Rally Co. is not responsible for any accidents.

12. Branding Event stickers must be applied and visible on vehicles during the event. These are non-permanent and provided by the organiser. Apex Rally Co. is not liable for any damage caused during application or removal.

13. Image Rights Participants consent to being photographed or filmed. Apex Rally Co. may use this content for promotional purposes. Personal filming and photography for non-commercial use is permitted.

14. Intellectual Property All branding, media, and website content are owned by Apex Rally Co. and its licensors. No rights or licences are granted without written permission.

15. Event Imitation Participants may not organise or replicate any Apex Rally Co. events or use any elements of its brand or activities. Legal action will be taken against infringements.

16. Transfers Deposits and payments are non-transferable unless agreed in advance.

17. Force Majeure Apex Rally Co. is not liable for cancellations or changes due to events beyond its control, including but not limited to war, terrorism, natural disasters, or transport disruptions.

18. Travel Delays Apex Rally Co. is not responsible for delays affecting travel or itinerary. Additional expenses incurred due to delays are the responsibility of the participant.

19. Disclaimer of Warranty You agree to indemnify Apex Rally Co. and its representatives against any legal action resulting from your actions.

20. Violation of Terms Violation of any term may result in immediate removal from the event.

21. Governing Law These terms are governed by English law and subject to the jurisdiction of English courts.

22. Third Party Tours Tours promoted with third parties remain fully managed by Apex Rally Co. Agreements are between participants and Apex Rally Co. only.

Website Terms of Use and Privacy By using our website, you agree to be bound by these terms. If you disagree, do not use the site or book events.

Disclaimer All website content is provided "as is." We are not responsible for inaccuracies or errors and are not liable for damages from use of the site.

Limitation of Liability Apex Rally Co. is not liable for any indirect, incidental, or consequential damages from site use or event participation.

Intellectual Property All website content is protected. You may not copy or use content without written permission.

Severability If any clause is invalid, remaining clauses remain in force.

Modifications We may change terms without notice. Continued use of the site implies acceptance of changes.

Privacy Policy We do not sell or share your data. Data may be processed overseas. We collect information such as IP addresses and cookies for analytics and remarketing. You can opt out via your browser settings or third-party tools.

Third Party Links We are not responsible for content or data protection on external sites linked on our website.

We are not responsible for delays outside our control

If our supply of your service is delayed by an event outside our control, such as travel disruption, timetable changes to booked transport, or any venue changing the date of an activity we will contact you as soon as possible to let you know and do what we can to reduce the delay. As long as we do this, we won't compensate you for the delay, but if the delay is likely to be substantial you can contact us to end the contract and receive a refund for any services you have paid for in advance, but not received, less

reasonable costs we have already incurred.

You are responsible for ensuring your eligibility to participate and your behaviour

You are responsible for ensuring that you have the necessary driving licence or permit to legally participate and that your vehicle is fully insured and road worthy to the laws and requirements of every country you will be driving through.

You are responsible for any fines associated with your driving and your behaviour.

You are responsible for being fit to drive. This includes having the legal standard of health and eyesight, not suffering from any illness or disability that may make it unsafe to drive or being under the influence of drink or drugs.

You are responsible for driving with reasonable skill and care and agree to indemnify us for any action or claims for damages (including costs) which may be brought against us, arising from negligent, reckless or irresponsible driving.

You are responsible for telling us any information that you deem important to your enjoyment of the event. For example, you require an accessible hotel room. If you do not tell us at the time of booking or in a reasonable time for us to make every effort to

accommodate, then we are not responsible your reduced enjoyment or inconvenience.

You are responsible for conducting yourself and ensuring that your guests conduct themselves in an acceptable manner so as not to interfere with the enjoyment of others. If you do not conduct yourself in such a manner and it results in problems during the event such as being asked to leave a hotel or venue or being arrested, we are not responsible for any refunds, repatriation or compensation and our contract with you immediately terminates.
